Pre trips and logbooks
Question:
If a log book is not required because you drive local only, is proof of pretrip reqiured, or any type log book required? Answer: You still need to fill out a vehicle report form when you do your pre or post trip ( law doesn't specify which). @#*!%$^@! _________________ @#*!%$^@! Answer: Your employer is required to supply you with the Daily Inspection Report. If he doesn't know where he can get them, tell him to go down to the local truckstop. They should sell them there for about 2-3 bucks. I prefer a pre-trip inspection. (e) 100 air-mile radius driver. A driver is exempt from the requirements of § 395.8 if: (e)(1) The driver operates within a 100 air-mile radius of the normal work reporting location; (e)(2) The driver, except a driver salesperson, returns to the work reporting location and is released from work within 12 consecutive hours; (e)(3) At least 8 consecutive hours off duty separate each 12 hours on duty; (e)(4) The driver does not exceed 10 hours maximum driving time following 8 consecutive hours off duty; and, (e)(5) The motor carrier that employs the driver maintains and retains for a period of 6 months accurate and true time records showing: (e)(5)(i) The time the driver reports for duty each day; (e)(5)(ii) The total number of hours the driver is on duty each day; (e)(5)(iii) The time the driver is released from duty each day; and (e)(5)(iv) The total time for the preceding 7 days in accordance with § 395.8(j)(2) for drivers used for the first time or intermittently Local drivers are exempted from the log provided all of the conditions listed are met. The regulation states that "the driver shall: Be satisfied that the motor vehicle is in safe operating condition"-------It does not require a driver to show any time on the bottom line! All a driver really has to do to cover himself, is a "note an inspection". I do show 15 mins. on the bottom line before each trip and this includes hooking up and a pre-trip, but at the end of the day, I only a line for my location and "note 5 mins. for post trip", I do not show 15 mins. 396.13 Just a grouchy old man. So I should only need to get a daily inspection report, correct? My employer is new at this also, and is just getting things together. Answer: Phoneman, hopefully your employer has applied for a US DOT Number and is scheduled for a Safety Audit. If you and your employer are unsure about DVIR's then there are probably many other points of interest that should be discussed. In addition to the DVIR's there is annual inspections, D & A testing, DQ files, CDL's, insurance and HM to mention a few. I would recommend a visit to FMCSA's Web Site Be safe. John Q. The only time that you would ever have to log is if you work 12 hours or more per day or drive outside the 100 mile radius. At the end of your shift, just fill out the VCR form. For the record a CMV has two different definitions with different requirements for each defintion. See Part 390.5 for one defintion and Part 382.107 and Part 383.5 for the other definition. A little story goes with this. The guy who was there before me got stopped by Georgia DOT. They found nineteen violations and quit writting. They let the guy off, but the company had fifiteen days to get in order or face a massive fine. They are trying to comply, just not experienced with it.
