The dispatcher told him today that "if he thinks he's going to collect unemployment, they already have it taken care of and he's not going to collect a dime." Hubby want's to know what do they mean. He's kept all the Yahoo maps she's given him with the travel times and mileage on them. I can of course go through Layover's maps for the same trips to disprove her as far as times and mileage goes. Cross referenceing these with his log books should prove him to be correct - right? Now Once this is proven, won't DOT go after him? Answer: Answer: As far as this goes they probably listed him as being fired or that he quit without notice or some such and more than likely this will make it difficult to collect. In many states if you loose your job for anything other than being layed off or your employer going out of business it is very difficult to collect anyway. Only two things I know of are infinite. The universe and human stupidity, and I am not real sure about the universe. Answer: Correct about what? Did he have to log in violation to perform the work to the company's satisfaction? If he did, he may prove that -- but he'll also prove he forged federal documents (his logs). He's not supposed to do that, no matter how much pressur he's under. It's illegal. Sort of a catch-22, and one major reason why it's virtually impossible to go after one of these employers. You have to first prove you repeatedly violated HOS regulation. That makes the driver just as guilty -- actually more so -- than the company for allowing you to do it. Kind'a the kettle calling the pot black, in the eyes of the courts. If you pursue this, those logs will analyzed very, very closely. Remember. The driver is responsible to the company to drive-out his available hours on demand, in a reasonable amount of time. The driver is responsible (personally) to enforcement to properly log the work in compliance with HOS regulation. The driver is.......usually screwed. Answer: Why are you so worried about unemployment benefits? Why not just do what he needs to, drop the truck off and go to work some where else? Even if he could collect unemployment with a CDL they are going to look at him a laugh and start digging as to why he can't find a job driving something. Also if this driver's home state is anything like Illinois it will take at least 6 weeks before he would be eligeable for unemployment since he either officially quit or was fired. I think companies like this need to be exposed for what they are. Mike Answer: When it's over, it's over. Cut your ties (return all their stuff) as quickly as reasonably possible. This is how the industry is. This is what everyone means when they talk about how ruthless and difficult this industry is. If he really wants to be a career driver, he'll have to choose his battles carefully. Just go out and get another job as quickly as possible to reduce the impact on your cash flow, etc. No way he's getting unempoyment. He may want to re-think this career. All these jobs and carriers have pluses and minuses. If it isn't one thing, it's another. It's unusual for someone to have this much trouble, this soon, on their first job, if they're going to last as a truck driver. What's done to drivers is wrong -- but it's how it is. If he can't adjust, he should get out now. I think most of us wonder sometimes if we should do the same thing. No truly rational person would put-up with this life. He sent himself to school and then tried like heck to get hired on with some company. They won't take him because he was laid off (construction) alot. There is nothing that he'd want more than to have a company pick him up. He is hoping that he can go into a training program since he was never sent out with a trainer before.
