Explain how he should.......
Question:
handle this situation and the dispacher.
First of all I wish he'd/we'd taken heed for warning when everyone on this site gave all the helpful information. But he was so affraid of getting fired and the fact that in school they clearly said that in your first year you don't make waves (otherwise it could be reported to DAC as newbie being a trouble maker).
Now, whats going to happen when he informs dispatcher that he can't move until Saturday? Has anyone been in this situation?
uturn2001 is correct that this is a small company and the turn over, from what I have seen, is great as far as getting rid of employees.
Is there anyone that he can report this company to and will he be able to collect UC Benifets if it comes to that?
Also, does anyone know who hires people with under 4 months experience. Hubby feels that going out with a trainer would be the best route since this company never did train him like they said they would.
U folks are the greatest for being helpful - even John Q Public.

Answer:
there is a big difference between making "waves" and knowingly violating the law. Making waves would be things like having enough time and hours to run a load and refusing to do it simply because you don't want to.
Now then, it is nothing new for a newbie to leave his/her first company before getting a year of experience in. Companies realize that mistakes are made due to a lack of experience and knowledge in the industry and are willing to overlook this. It is when a newbie is on his third, fourth or fifth job in the first year or two that big red flags are raised.
Apply to training companies like Werner, Swift, Schnieder, Willis Shaw, Crete, Rohel, Millis, etc that hire out of your area. Be sure to researxch these companies before accepting any job offers to make sure they are going to meet your needs as far as hometime, benifits, pay, etc.
With only four months experience your husband will go in as a newbie. He will be going out with a trainer. It may be for the full training period or it may be for a shortened period since he does have some experience.
Instead of filling out several applications what you can do is utilize some of the web applications that will send your info to many companies. Truck net has such a service, classadrivers.com, 1800drivers.com, and several others as well. You can find many of these sites by typing truck driving jobs into your favorite search engine such as excite or yahoo.
The worst thing that can legally happen when he tells his boss he cant move for several days is that he gets fired, but since they are a small company it is doubtful that they will have him clean his truck out on the spot as then they will have to recover it. If it does happen then have him be sure to get written, signed notification/instructions of this so that if they try to stick him with truck abandonment he has proof he was following the company's orders. More than likely though there will just be a bunch of griping, whinning and empty threats.
Only two things I know of are infinite. The universe and human stupidity, and I am not real sure about the universe.
Answer:
Keep copies of his logs, bills of lading and a phone log of people, when the conversation took place, and what the conversation was about.
