Tale of 2 D.O.T.
Question:
Wuz ran into 2 D.O.T. this week.
!st time:
Passing a car on the right, D.O.T. came over a hill, saw it, pulled me over. $66.50 later, bye-bye, have a nice day.
Was on the right for a reason (didn't want to rear end this idiot) but---D.O.T. DID NOT see what caused it, just the result.
Young guy, eager, no give. So, bye bye money.
However, as Chrystal Pistol can tell you, they have to go by what they see, not not what they hear. So, will pay the ticket and suck it up.
2nd time:
Older D.O.T. Stopped me on a county road. Curious why a road truck was there. Had made a delivery to a farm, showed him the receipts.
When he asked why I didn't have a seat belt on, offered to put him in the passenger seat and take him down the gravel road at 45 m.p.h.
He laughed, declined, and gave me a warning for seat belt.
Point is?
Whatever happens when you get stopped depends entirely upon the attitude AND what the person who stops you sees.

In the case of passing on the right, you cannot exceed the speed limit, but if you are driving a truck in the right lane (which is always your best choice on a two-lane Interstate) and are going the speed limit or below, you can overtake a vehicle going much slower without it being called an unlawful "pass on the right." The law certainly does not expect you to slow down to a crawl and become a road hazard just because someone in the left lane chooses to do so. If this is what was really going on in your case, I can certainly understand your frustration.
BUT
If you are moving along in the left lane, then go to the right to pass a vehicle going the speed limit, then return to the left, you will have a harder time defending that action.

Department of Transportation. Some states have this on the side of their cars.

Check the code violation and be sure it does not fall into the serious catagory. If you are not sure post the state and the code number from the ticket and I will check it for you. Passing on the right is not considered a serious violation but he might have put down a lane violation which is serious.
I never recommend that you just pay the ticket. Some states still allow CDL drivers to take traffic school. VA has one set up just for truckers and some states will allow online traffic school.
It pays to fight every ticket because of the way insurance companies are dictating who can drive and the effect on your personal car insurance.

......... it wouldn't have been a violation under the law as it pertains to passing here in this state anyway, not the way it's presented anyway.

I did a camper that pulled off the shoulder right in front of me,be damned if I was locking down the brakes in heavy traffic and getting run over.I was in a pickup.
I didn't get caught
In Wuzzy's case he should just send them the money,it ain't like he is going job shopping unless the company he is with folds up and with all his years experiance,somebody would listen to his explanation with open ears.His record is probably clean and one minor mark ain't going to effect him much.
Depending on the Judge would make or break his attempt to get it dismissed.The judge may think he is on the up and up or may think that he has been let slide a bunch of times by going to court and thats why he has a clean record.
