Question:
I have the opportunity to hopefully get on a local gig in Belleville and am trying to get on a Union gig.
So here is my question... If I was working for the non union guy in the AM and working for the Union gig in the PM could I do that legally?
Just wondering. If it doesn't make sense I will try to make sense of it.
I want to work for this guy in town. He is home everyday at around 5-6. The union company runs 24-7. So I could work 9-5 or so at the non union job and then work with the Union company part time until I was on full time.
Does that make sense?

Don't see why you couldn't work both jobs. One thing though, you gotta log your hours worked at both jobs if you're a driver.

Answer:
You would have to log all your time at both jobs regardless if one or both are driving positions, and still comply with all HOS regs.
As per 395.2
On duty time means all time from the time a driver begins to work or is required to be in readiness to work until the time the driver is relieved from work and all responsibility for performing work. On duty time shall include:
(1) All time at a plant, terminal, facility, or other property of a motor carrier or shipper, or on any public property, waiting to be dispatched, unless the driver has been relieved from duty by the motor carrier;
(2) All time inspecting, servicing, or conditioning any commercial motor vehicle at any time;
(3) All driving time as defined in the term driving time;
(4) All time, other than driving time, in or upon any commercial motor vehicle except time spent resting in a sleeper berth;
(5) All time loading or unloading a commercial motor vehicle, supervising, or assisting in the loading or unloading, attending a commercial motor vehicle being loaded or unloaded, remaining in readiness to operate the commercial motor vehicle, or in giving or receiving receipts for shipments loaded or unloaded;
(6) All time repairing, obtaining assistance, or remaining in attendance upon a disabled commercial motor vehicle;
(7) All time spent providing a breath sample or urine specimen, including travel time to and from the collection site, in order to comply with the random, reasonable suspicion, post-accident, or follow-up testing required by part 382 of this subchapter when directed by a motor carrier;
( Performing any other work in the capacity, employ, or service of a motor carrier; and
(9) Performing any compensated work for a person who is not a motor carrier.

Answer:
If he stays within a hundred mile radious he won't need a log. If not he will use one or the companies may require it. If he has to use a log he will run out of hours fairly quickly.
Hopefully one job wont interfere with the other as far as start/stop times. I wouldn't have 2 driving jobs if either one required alot of hours.

Answer:
The 100 air-mile exception is from the log not the HOS.
The driver would still be in violation of the 10/15-hour rule as I don't see any way to work 2 jobs and have 8 consecutive hours off-duty for the required rest which will move to 10 hours in January 2004.
Not to mention driver fatigue covered by Part 392.
I would think about the situation very seriously, if you have a crash and kill someone..... You'ld probably go to jail.

Answer:
That is what I thought.
I just thought that if I was driving for one company that the 10/15 rule apllies there and I would be eligible for a new 10/15 with the other company.
