Durham, N.C., woman wins $1.2 million settlement from trucker DURHAM, N.C. -- A Durham, N.C., woman has won a $1.2 million crash settlement, a higher-than-normal figure because the trucker involved doctored his logbook, The Associated Press reported. Jennifer Spring Blachly was injured in a September 2000 crash on I-85 when two tractor-trailers collided and one of them was knocked into Blachly's car. Driver Harry L. Copenhaver was traveling side by side with another driver, Anthony P. James, when Copenhaver swerved and hit James' truck, knocking him into Blachly, AP said. Copenhaver had reported being on the road 10 hours when he was really behind the wheel for 11 hours, according to AP. Blachly's suit claimed Copenhaver not only was over hours at the time of the crash but on several days leading up to the crash, AP said. An attorney told AP he believed the insurance company for one of the truckers agreed to a "higher-than-normal" settlement because of a falsified log. Blachly was 22 at the time and had an infant. She received "serious" injuries to her neck, pelvis and legs and was left with partial disability in an ankle, one of her knees and one of her legs, AP said. Charles Answer: The law suit might seem excessive,but i can see the reasons on this one.If the driver had shut down like he was supposed to,maybe the accident would never have occured,saving everyone the heartache of an accident!! Answer: Thats true rockefeller. I had a expedite dispatcher tell me one time that another driver was running loads despite being out of hours and there for why shouldn't I do it? Its these drivers that are willing to break HOS that puts the pressure on those who will not. They think just because they get away with adjusting their books for many years that something bad will never happens because of it. Like the big pile up in tenn where 2 drivers were fined 5000$$ each for falsifying log book. If you are in an accident and you have doctored your log you will be blamed no matter what.
