Help big problem durg test
Question:
I am a recent graduate and started my first job with a company. I had had the flu 4 days before my first day (drug test). Needless to say i failed the test. I DO NOT DO DRUGS never have and I have never failed a test before. I didn't know at the time but the people doing the collection procedure didn't follow the DOT specified procedure for collection. I know this now because I looked it up, they made about 20 mistakes. Fleet mar told me to call safety I have 5 times noone will call me back. Iwant this fixed and don't know how. HELP PLEASE!!!!! I don't want my career ended before it gets started.

Answer:
You can contest any positive drug tests, which is why they split the sample into two parts. You may very well have to pay for a re-test, and if I remember correctly you can also request the test be done by another lab other than the one that originally did the test.
This all should be spelled out on the custody reciept you got for the sample. I would also be sure to list out all medications you are or have been taking in the 30 days prior to taking the test, both prescription and OTC.
Answer:
I didn't get my copy and have no idea what company did the testing. I don't want the second half tested because the chain of custody was broken about three times. I didn't get a aterile cup to begin with and had to sign the paperwork way before the test and didn't even see the tech pour the samples up. He was being trained and his trainer was calling for me to come take my eye exam.....In another room

Answer:
I would seriously think about contacting an attorney that is familar with the transportation industry as well as drug and alcohol testing procedures.
If the chain of custody was broken then the lab results are suppose to be ruled as invalid.
If you want try emailing or sending a PM to Opie. He is the forum moderater in the law forum here on Truck Net.
Answer:
Thanks I just did that

Answer:
mamaoz; the handling of your goods was botched from the very beginning. When you have a drug screen; everything is suppose to be sterile. You get a sterile cup to put your sample in. THe person doing the testing transfers the sample into a sterile container that is suppose to go to the lab for testing. They mark it , seal it, you initial it, and witness this whole proceedure. You also get a copy of the paperwork associated with the tests. This at least is the way it has been done when I've had to do a drug screen. If ths proceedure was not followed and your drug screen was not handled sterily it is invalid. If you are clean I would definitley follow through to get this cleaned up. Your career should not end before it gets started. If what you said is true; there is a trail of mishandling all over the place. Go safely; see you on the big road!

One thing I am wondering is:
Do we now have a crack head running loose on the highways?
Assuming the collection was as bothched as indicated then it is well within the realm of possiblity that his sample was switched with another persons before it ever left the collection site.

Answer:
I sit down the hall from the safety director's office, and I must've heard 6 or 7 times in the last year the same argument from recent hires who flunked the drug screen. Almost every single time, it was because they tested positive for cannabis.
The problem is, unlike coke, crack, meth or heroin, pot will stay detectable in your blood for at least 2 months from the last time you used. So, if you are just an occasional toker, you need to give it up a full season before you test to be safe.
OTOH, you could be smoking crack or shooting smack a week before you test, then cleanse your system and still pass. Maybe it's not fair, but that's the way it is.
Answer:
What about second hand smoke from pot? will it show up in blood for just as long too? sometimes i can smell someone smoking it and i try to stay away from them, but i still might have breathed some in.

What has having the flu got to do with failing a drug test?
Big

Answer:
Some of your night time flu medicine has stuff that will certainly fail a Alcohol test. Some are said to have barbituants as well. That will fail a drug test. That is why they ask what prescriptions OR over the counter medicine you have been taking.
Take Sudefed and Tylenal day time meds. See if you do not trip your but off. I bet that would help fail a drug test.
The test will show the counts and levels of each area. What area was failed?
Was it THC? Can't blame that on the flu. Codine? Can blame that on a tooth ache if you have a prescription for Tylenal 3.
Did you take some prescription drugs from the doctor for the flu?
I would ask that the split sample be tested. There should be two samples.202 N Main Street

Also have to watch the GENERIC remedies for various ailments they show up as ?s during drug test.

Answer:
FYI, for everyone who replied back! I did not test positive for pot, , crack or codeine I tested pos for amphetamines, not meth amphetamines. I have been doing some online research and found out that some cold and allergy meds can come up with a positive reading. Therefore the split sample will come up with the same reading. The whole point of my question was what do I do about it. I have called safety, they won't call back, I have called the field office of the FMCSA and they told me to call the HR department at the co. I did, they told me to call the lab that did the collections, I told them I didn't know who that was, they gave me a number to call. I called them, they gave me another number to call, I called them, they told me to call my company.
After all of this I still have no answer as to what to do and they couldn't retest the sample anyway because it is only viable for 72 hrs. Now I repeat myself I DO NOT DO DRUGS!!!!!!!!! What do I do

Answer:

GIven your description of the situation, you need to employ an attorney to at least send a few registered letters. Perhaps that will get someone's attention.
