New Hazmat Law
Question:
I graduated driving training on Feb 1st with a hazmat endorsement in arkansas. But it was a waste of time taking the test for it. Now i have to pay more money here in MO to take it again after a long wait to get checked by the fbi. I called the trainer at USA that I was supposed to talk to,she gave me very little info,I asked about what do I do now that I dont have a hazmat endorsement and she didnt know.She told me to wait and tell my driving trainer. Isnt that kind of like waiting for the last minute. Anyone have some good advice as what to do now? Answer: Let me see if I get this right...................You live in Missouri I assume.....and USA truck sent you to school in Arkansas and assisted you in getting a full blown Arkansas CDL w/hazmat BUT failed to inform you that when you went back to the home state and transferred the CDL, that hazmat WOULD NOT transfer without another test and another charge??!! Did I interpret that right???? If I did, and I was in your shoes........I would inform my driver manager that I do not have a hazmat endorsement at this time,because of the misinformation. If company is willing to spring(pay) for the new hazmat test,cool I will go get it right away.......otherwise it will have to wait till I get some cash in my pocket and get a day off to visit the DMV......pretty simple............dont let them push you around.........they need you just as bad as you need them and not having a haz endorsement for a month or 2 aint gonna kill anybody!!!! CDrecovering dweller..........oilfield trash division Answer: Well you have always had to retake the hazmat test any time you change liscenses from state to state. Nothing new there. Where the new clitch is coming in at is with the background checks. Companies are being caught short because they have failed to take into account what this means for drivers. Answer: What I would like to know is: How in the devil did you get an "Arkysaw CDL-A with Hazmat"......when you live in Missouri?????? Something sounds a touch "hokey" here. If you had a full CDL-A w/H....and just got it...why are they requiring you to retest so soon....? And why didn't you school with a temporary permit and then get your CDL-A in MO? Sounds like someone hosed you down good!So I like what I do, you don't, too bad, get over it. Get on with your life, I am. Answer: Such as this is what the nay sayers have been speaking of. As already mentioned, i would let the driver manager or whomever know immediately. Big Answer: Before the background checks it was a simple thing for a driver to switch lisneces back and forth between states. All one had to do was go in to the new state, pay the fees, take the hazmat test and you were done. Many companies, both CDL schools and trucking companies who sponsor training, have out of state students give up their home state liscence and get a liscence in the state they are schooling in. That way they do not have to arrange to get the student, a liscenced driver and a truck to the students home state for the skills test. Answer: OK, how do you get a license in a state you do not reside in? Unless you are using the schools address or a motel address, which I would think would be illegal as it is not your "legal residence". Because if this is the case..... you have just found a way to defeat the law against CDL holders having more than one CDL. Lets see: You get the CDL learners permit in your home state..... then go to school in another state...get their CDL, return to your home state...turn in your test results along with the learners permit and get the CDL from your home state, and never say a word about the CDL from the other state. Voila' you now have TWO CDL's. Thats why I think it soundey "hokey". I can't speak for other states, but in Florida you have to have a Florida address, (but I'll bet someone will pipe up and say they have one with another states address on it..........)and if you have a hazmat endorsement you have to have a physical address not a po box on the license.....they made me give them my boat slip address last time I renewed.....kinda silly..... since I'm only home maybe 3 or 4 days a month....but they wanted to know where to find me So I like what I do, you don't, too bad, get over it. Get on with your life, I am. Answer: OK let me see if I can answer all your questions. I went to school in arkansas. Got my learners permit there. Went through training and took all skills and road test there. I then had to go to the dmv in arkansas and get a 90 day cdl. But was not given the hazmat endorsement i tested and passed for. Because the new hazmat law went into effect the day before i finished so arkansas didnt put the hazmat endorsement on it anyway. Now i am back in my home state of Missouri and i will have to pay more money that i dont have since i have been at school for 3 weeks and not working. When i talked to usa, the lady there didnt have a clue as what to do.........imagine that. But i will take the advice from the ones that gave it and just let them wait til i can afford to get it and no they dont reimbursr the fee. The school told me that before i left. They do USA orientation there too,but are not affilliated with USA. Answer: When I went to Schneider in 1994, I went to Indianapolis, Indiana for my retraining. I started with an Indiana learners permit...and finished with an Indiana CDL-A with all indorsements except passenger. I too live in Missouri, and I was told that when I returned to my home state, I would have to transfer the Indiana CDL for a Missouri CDL. The only test I had to take over was the HazMat test. It wasn't that hard, and yes....I had to pay for the test too. No big deal! If I'm not mistaken.....I believe you would have to transfer the license to where ever your home state is! I questioned it because when I went to school in 94' in FL....it was up in Green Cove Springs, (N FL) and we had some guys with GA permits....because they were from GA. I honestly didn't know you could get a learners permit from a different state than your legal residence. Maybe things have changed? Thanks!So I like what I do, you don't, too bad, get over it. Answer: You have not defeated anything, unless maybe you can find someone to let you use a truck and take the skills test all over again because you must turn in your physical liscnese when getting one in another state. Answer: I was thinking in terms of "different processes". What I outlined was a scenario involving learners permits and 3rd party examiners results. A 3rd party examiner can test for more than one state if certified by different states. Maybe the examiner in Arkansas wasn't certified for MO, or MO doesn't have a reciprocity agreement with AR on 3rd party examiners..... It just seems abit weird... but hey, anythings possible, especially in Arkansas !So I like what I do, you don't, too bad, get over it. Get on with your life, I am. Answer: My main complaint is why did i have to pay to take an arkansas hazmat test when i got to take it here in missouri,and on top of that i have to pay for a background check before i can even retake the hazmat test. Problem number two is that i talked to a USA trainer and she had no idea what will happen if i dont have a hazmat endoresment which USA requires.
